Terms of service

Last Updated: October 10, 2026

These Terms of Service (“Terms”) govern your access to and use of https://portorangebaitandtackle.com (the “Website”) and your purchase of products from our online store.

The Website and store are operated by Rick’s Port Orange Bait & Tackle under the brand name PORTORANGEBAITANDTACKLE (“we,” “us,” or “our”).

By accessing the Website or submitting an order, you agree to these Terms. If you do not agree, please do not use the Website or place an order.

1. Eligibility and Customer Information

You must be at least the age of majority in your state of residence to place an order.

You agree to provide accurate, current, and complete information during checkout, including your name, email address, telephone number, billing information, and shipping address.

You are responsible for reviewing your information before submitting an order and for keeping any customer-account credentials confidential.

You agree to notify us promptly if you become aware of unauthorized activity involving your customer account.

2. Products and Product Information

We sell fishing rods, fishing reels, and related fishing gear for recreational fishing activities.

Our product selection may include:

  • Spinning fishing rods;

  • Fly fishing rods;

  • Carbon fishing rods;

  • Telescopic and sectional fishing rods;

  • Spinning fishing reels;

  • Baitcasting fishing reels; and

  • Other fishing equipment and accessories offered on the Website.

We make reasonable efforts to display product descriptions, dimensions, materials, colors, specifications, photographs, and prices accurately.

However:

  • Colors may appear slightly different depending on lighting, photography, and screen settings;

  • Dimensions and weights may vary slightly within reasonable manufacturing tolerances;

  • Product materials and finishes may have minor variations in texture, color, or appearance;

  • Products may be packaged with protective materials or separated components for transportation; and

  • Fishing rods, reels, lines, lures, or accessories shown together in product photographs are not necessarily included unless specifically stated in the product description.

Customers should review the complete product description, available dimensions, weight, rod construction, reel configuration, compatibility information, and other relevant specifications before ordering.

3. Product Use and Care

Our fishing equipment is intended for recreational fishing activities as described on the applicable product page.

Customers must use products according to their descriptions, specifications, and any provided instructions.

Unless expressly stated otherwise, customers should:

  • Use fishing rods with compatible fishing reels, lines, and tackle;

  • Follow the specified rod length, power, and lure-weight recommendations where provided;

  • Secure fishing rod sections and reel attachments before use;

  • Avoid excessive bending, impacts, or force beyond the product's intended use;

  • Check fishing rod guide rings, reel handles, and other components before fishing;

  • Rinse appropriate equipment with fresh water after exposure to saltwater;

  • Dry equipment thoroughly before storage; and

  • Store fishing rods and reels in a clean, dry location.

Fishing rods and reels may contain small components, moving mechanisms, and parts that require appropriate handling.

Customers are responsible for using fishing equipment carefully and following applicable local fishing regulations.

Damage caused by misuse, improper assembly, incompatible equipment, modification, improper storage, or failure to follow product instructions is not considered a manufacturing defect solely because the damage occurred during use.

Nothing in this section limits rights or remedies that cannot legally be excluded.

4. Product Availability

Products are offered subject to availability.

Placing a product in the shopping cart does not reserve it.

We may limit purchase quantities, discontinue products, or correct availability information when reasonably necessary.

Fishing rods and reels may be available in different lengths, configurations, or specifications.

Availability may vary by product option.

If a product becomes unavailable after an order is submitted, we may contact the customer regarding the affected item or cancel it and issue an appropriate refund to the original payment method.

5. Orders and Acceptance

Submitting an order constitutes an offer to purchase the selected products.

An automated order-receipt email confirms that we received the order but does not necessarily mean that the order has been accepted.

An order is accepted after payment has been successfully authorized and we confirm that the order can be fulfilled.

We may decline, limit, or cancel an order for legitimate reasons, including:

  • Product unavailability;

  • Incorrect pricing or product information;

  • Payment-authorization problems;

  • Suspected fraud or unauthorized activity;

  • An incomplete or invalid delivery address;

  • Orders outside our supported shipping area;

  • Unusually large quantities or suspected unauthorized resale; or

  • Legal or regulatory requirements.

If we cancel an order after payment has been collected, we will issue the appropriate refund to the original payment method.

We will not substitute a materially different product without the customer's agreement.

6. Prices and Payment

All prices are displayed in United States dollars (USD) unless otherwise stated.

Applicable shipping charges and taxes will be displayed during checkout before the order is submitted.

We currently accept payments through PayPal, as described in our Payment Policy.

PayPal processes payments according to its own terms and privacy practices.

We do not directly request or store complete payment-card numbers, card security codes, or PayPal login credentials.

Customers should review the total payment amount before submitting an order.

Further information about payment methods, authorization, declined transactions, and refunds is available in our Payment Policy.

7. Pricing and Website Errors

We make reasonable efforts to maintain accurate pricing, product descriptions, availability information, and technical specifications.

However, errors may occasionally occur.

We may correct:

  • Typographical errors;

  • Incorrect product prices;

  • Inaccurate product dimensions or specifications;

  • Product availability errors;

  • Incorrect shipping information; or

  • Other Website mistakes.

If an error materially affects an order, we may contact the customer to request confirmation or cancel the affected item and issue an appropriate refund.

We will not substitute a materially different fishing rod, reel, or other product without the customer's agreement.

8. Shipping and Delivery

We currently accept orders for delivery to eligible addresses within the 48 contiguous United States.

We do not currently ship to Alaska, Hawaii, Puerto Rico, other U.S. territories, or international destinations.

Order processing, shipping charges, delivery estimates, tracking, and shipping-related issues are governed by our Shipping Policy.

  • Orders of $99.99 or more: Free standard shipping.

These terms are subject to the eligibility requirements and conditions described in our Shipping Policy.

Delivery estimates are not guaranteed dates.

Certain fishing rods or oversized equipment may require additional packaging or handling during transportation.

Customers are responsible for providing accurate shipping information during checkout.

9. Returns and Refunds

Eligible products may be returned according to our Return and Refund Policy.

We accept eligible return requests submitted within 30 days after delivery.

Return eligibility depends on factors including:

  • The date the return request is submitted;

  • Product condition;

  • Signs of use;

  • Original components and accessories;

  • Product alterations or damage; and

  • Return authorization.

Customers are responsible for return-shipping costs associated with approved personal-reason returns.

Where a return is required because of a confirmed damaged, defective, incomplete, or incorrect product caused by us, we will be responsible for reasonable return-shipping costs.

Approved refunds are issued to the original payment method according to the timelines described in our Return and Refund Policy.

Nothing in these Terms limits consumer rights that cannot legally be excluded.

10. Personal and Household Use

Products purchased from the Website are intended primarily for personal and recreational fishing use.

Customers may not use the Website or purchase products for:

  • Fraudulent transactions;

  • Unlawful activities;

  • Unauthorized commercial resale;

  • Unlawful export or distribution; or

  • Other activities prohibited by applicable laws.

Wholesale or commercial resale arrangements require our prior written approval.

Customers are responsible for ensuring that their use of fishing equipment complies with applicable fishing laws, licensing requirements, and local regulations.

You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display submitted content for operating and promoting the Website and our products.

We may remove content that violates these Terms or applicable law.

We do not require customers to submit only positive reviews, and we do not prohibit customers from sharing genuine experiences with our products.

  • Use the Website for unlawful, fraudulent, or deceptive activities;

We may restrict access when we reasonably believe these Terms have been violated, subject to applicable law.

14. Shopify and Third-Party Services

By using the Website, you acknowledge that personal information will be handled as described in our Privacy Policy, subject to applicable privacy laws and rights.

16. Website Availability and Disclaimer

We make reasonable efforts to maintain accurate Website information and reliable operation.

However, the Website may occasionally be interrupted because of maintenance, updates, technical problems, or circumstances outside our reasonable control.

To the fullest extent permitted by applicable law, the Website is provided on an “as available” basis.

We do not guarantee that the Website will always be uninterrupted or error-free.

Product photographs, descriptions, and specifications are provided to assist customers in making informed purchasing decisions.

Customers should review the specifications and intended applications of fishing equipment before use.

Nothing in these Terms excludes warranties, statutory protections, or consumer rights that cannot legally be excluded.

17. Limitation of Liability

To the fullest extent permitted by applicable law, Rick’s Port Orange Bait & Tackle will not be liable for indirect, incidental, special, consequential, or punitive losses arising from use of the Website.

We are not responsible for damage caused by using a product contrary to its description, intended purpose, compatibility requirements, care instructions, or reasonable use conditions, except where applicable law provides otherwise.

  • Your unlawful use of the Website;

This provision does not apply to claims caused by our own violation of law or these Terms.

Nothing in this section limits rights or remedies that cannot legally be excluded.

19. Governing Law

These Terms are governed by the laws of the State of Florida and applicable federal laws of the United States, without regard to conflict-of-law principles, except where mandatory consumer-protection laws require otherwise.

Disputes will be handled by a court with lawful jurisdiction, subject to any mandatory consumer right allowing a claim to be brought elsewhere.

Nothing in this section prevents customers from exercising rights available under applicable federal or state consumer-protection laws.

20. Changes to These Terms

We may update these Terms when our Website, products, business practices, service providers, or legal obligations change.

The updated version will be posted on this page with a revised Last Updated date.

Changes apply prospectively and do not retroactively change the material terms of an order already accepted unless required by law.

Additional notice will be provided where required by applicable law.

We encourage customers to review these Terms periodically.

21. Severability and No Waiver

If any provision of these Terms is found invalid, unlawful, or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

Our failure to enforce a provision does not waive our right to enforce it later.

Any waiver of a provision must be made in accordance with applicable law.
